R-19-07 <br />2 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />3 COLTON UPHOLDING THE PLANNING COMMISSION'S DENIAL <br />OF A BUSINESS OCCUPANCY PERMIT TO ESTABLISH A <br />4 TRUCK MAINTENANCE FACILITY ON PROPERTY LOCATED AT <br />2001 WEST KEY STREET <br />5 <br />6 WHEREAS, Pacific Tank Lines ("Appellant") filed an application on or about November 27, <br />7 2006, for the processing and approval of a Business Occupancy Permit, BOP 116-080, (Reference <br />8 File Index Number DAP -000-591 filed May 22, 2006), to establish a truck maintenance facility on a <br />9 currently vacant industrial property located at 2001 West Key Street, Colton ("Subject Site"), <br />10 Assessor's Parcel Number 0277-022-64-000; <br />11 WHEREAS, under the General Plan the Subject Site is designated Light Industrial with a <br />12 Zoning classification of M-1 (Light Industrial); <br />13 WHEREAS, the proposed project is located within and is in conflict with the La Loma <br />14 Hills/Pellisier Ranch Area Moratorium ("Moratorium") which was established by the City Council <br />15 through Ordinance No. 0-17-06 on December 2, 2006; <br />16 WHEREAS, this Moratorium prohibits the City from issuing permits of any type for the <br />17 establishment of new land uses, buildings and building/use expansions on all properties located <br />18 within the boundaries of the moratorium; <br />19 WHEREAS, the City anticipates that a specific plan will be developed to guide future <br />20 <br />development of this area; <br />21 <br />WHEREAS, City staff have reviewed this project and have determined that the proposed <br />22 <br />new truck maintenance yard is considered a new land use and thus is in direct conflict with the <br />23 <br />Moratorium limitations; <br />24 <br />WHEREAS, on January 23, 2007, the Planning Commission considered an appeal of the <br />25 <br />26 Community Development Department's denial of BOP to establish a truck maintenance facility. At <br />27 the meeting, the Commission, on a 4-1 vote, upheld the Community Development Department's <br />28 denial of the BOP to establish a truck maintenance facility, due to the existence of the Moratorium <br />within this vicinity. <br />1 <br />RVPUB\PKNOX\727595.1 <br />
