Professional Services Agreement — Hall & Foreman, Inc. <br />June 191h, 2007 City Council / Redevelopment Agency Report <br />DISCUSSION/ANALYSIS: <br />Page 2 of 5 <br />October 24th, 2006, Request for Proposal RFP -JS -07013 was distributed to 85 potential bidders via <br />the City's online bidding system: www.TheNetworkBidSystem.com for the purpose of delivering <br />consulting services for the development of a Specific Plan in the Pellisier Ranch / LaLoma Hills <br />area. Sealed proposals were received from four companies — EDAW, Michael Brandman <br />Associates (MBA), David Evans and Associates (DEA), and the JHA Consulting, Inc. team (Hall & <br />Foreman, Inc. subconsultant). Each of these proposals was evaluated based on the criteria listed <br />in the RFP, including Quality of Workplan /Methodology, Ability to Perform, and Overall Cost. <br />Through that evaluation process, City staff determined that each of the consultants offered services <br />and professionals who could bring value to the city of Colton as the city embarks on aggressive <br />development opportunities. <br />As a result of this process, City staff has brought / will bring forward to the City Council items as <br />follows: <br />• Professional Services Agreement Award to DEA for the development of the Pellisier Ranch <br />/ LaLoma Hills Specific Plan (council approval June 5th, 2007); <br />• Professional Services Agreement Award to Michael Brandman Associates for the <br />Development of a Habitat Conservation Plan for the Delhi Sands Flower Loving Fly and an <br />Environmental Impact Report for the West Valley Specific Plan update (agendized for <br />council consideration June 19th, 2007); <br />• Professional Services Agreement Award to the Hall & Foreman' (HFI) for the Development <br />of a Specific Plan update for the West Valley project area (this item); <br />Colton Municipal Code Section 3.08.140 authorizes the city council, in limited circumstances, to <br />award a professional services agreement to a consultant without a formal or informal RFP process. <br />Section 3.08.140(E) provides that competitive bidding, either formal or informal, is not required <br />"When the city manager determines that it is in the best interest of the city and its administrative <br />operations to dispense with public bidding for non-public projects under this chapter. Prior city <br />council concurrence with the city manager's determination shall be required for non-public project <br />purchases over one hundred thousand dollars." <br />For this contract award, the City Manager has determined that the prior competition for the Pellisier <br />Ranch Specific Plan Development accomplished the purpose of a bid process and the results / <br />findings from that competition are valid to make a contract award under this project. The City <br />Manager makes this finding based upon the following: <br />• The Hall & Foreman team was considered very capable of completing the range of services <br />included in this Professional Services Agreement; <br />• The Hall & Foreman team received outstanding references from previous clients including <br />both public agencies and private sector developers; <br />• The Hall & Foreman team has direct experience in the development of mixed-use specific <br />plans in the Inland Empire. <br />' In the case of the JHA Consulting, Inc. team, the principle concern expressed by the evaluation committee was the size <br />and financial resources of JHA Consulting. To address this concern, JHA Consulting has proposed to the City that their <br />role be switched from a Prime to a Subconsultant position — Hall & Foreman will serve as the Prime consultant given their <br />size and financial resources (250 employees, $35 million in annual sales). <br />
