City Council Meeting — November 6, 2007 <br />PSA with Hogle-Ireland <br />Page 2 of 4 <br />the consultant completed a detailed Land Use Alternatives Paper, which provides the <br />foundation for completion of the Land Use Element. Two workshops have been held with City <br />Department heads to discuss the land use alternatives. In April 2007, staff was prepared to <br />schedule community meetings to discuss the land use alternatives. However, these were put <br />on hold because the consultant team was in the process of leaving their prior consulting firm. <br />The consultant team working with the City on this project includes Laura Stetson and Diana <br />Gonzalez. Ms. Stetson's experience with the contract work -in -progress and her unique <br />familiarity with the work plan that had already been established by P&D Consulting, Inc. make <br />her — and Hogle-Ireland, Inc. — an ideal candidate to continue with the contract. As a result, <br />staff is recommending that the current contract for the completion of the Land Use and <br />Circulation Elements be awarded to Hogle-Ireland. <br />Professional Services Agreement with Hogle-Ireland, Inc. for Completion Land Use and <br />Circulation Elements, Housing Element, and EIR <br />In addition to updating the Land Use and Circulation Elements of the General Plan, the City's <br />Housing Element needs to be updated to meet the requirements of State law and to respond to <br />the current SCAG cycle requirements to have the element updated for the 2008-14 planning <br />period, reflective of the final Regional Housing Needs Allocation adopted by SCAG on July 12, <br />2007. <br />Funding to complete this phase of the contract in the amount of $313,000 will be included in <br />Fiscal Year 2008/2009 Budget. Finally, the environmental impacts of all of these elements and <br />ordinances still needs to be prepared before they can be considered by the Planning <br />Commission and City Council. As a result, Hogle-Ireland's proposal also includes preparation <br />of the EIR. These tasks include the original phase 2 projects identified in the scope of work. <br />Ms. Stetson's experience working with the General Plan, and with the City of Colton, puts <br />Hogle-Ireland, Inc. in a uniquely qualified position to serve the City's needs in these areas. <br />Generally, the awarding of a new professional services contract would be subject to the <br />competitive bidding procedures described in the Colton Municipal Code (the "Code). <br />However, for non-public projects, such as the awarding of this contract there are exceptions <br />that allow for a waiver of the bidding process. Specifically, Section 3.08.140 (Exceptions to <br />competitive bidding — Non-public projects) states that the City's bidding requirements may be <br />waived "[W]hen the city manager determines that it is in the best interest of the city and its <br />administrative operations to dispense with public bidding for non-public projects under this <br />chapter. Prior city council concurrence with the city manager's determination shall be required <br />for non-public project purchases over one hundred thousand dollars." <br />Thus, if the City Manager (and City Council) determines that it is in the best interest of the City <br />to dispense with public bidding for this contract, then competitive bidding will not be required. <br />Staff believes that Hogle-Ireland, Inc., with Ms. Stetson as the Project Manager, is ideally suited <br />to perform this contract due to the firm's overall familiarity with the City and the City's General <br />Plan as a result of its continued work on the Land Use and Circulation Elements Update. <br />Indeed, much of the background information for the General Plan has been performed by Ms. <br />Stetson. If the City were to formally bid this project and select a different consultant team, that <br />
