ITEM #1 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF JUNE 17, 2008 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: MARITZA TAPIA — INTERIM PUBLIC WORKS DIRECTOR <br />SUBJECT: APPROVAL OF TWO RESOLUTIONS FOR LLMD1: 1) RESOLUTION <br />APPROVING THE ORDER OF THE LEVY AND COLLECTION OF <br />ASSESSMENTS FOR FISCAL YEAR 2008/2009 2) APPROVING THE <br />FINAL ENGINEER'S REPORT. <br />DATE: JUNE 9, 2008 <br />BACKGROUND: <br />In compliance with the Landscape and Lighting Act of 1972, Part 2 of Division 15 of the Streets and <br />Highways Code of California, the City Council formed a Landscape and Lighting Maintenance <br />Assessment District. Currently, there are two Landscape Lighting and Maintenance Districts <br />(LLMDs) within the City of Colton. Each District is provided the services of maintaining lighting, <br />landscaping and all applicable facilities within its boundaries. <br />Within the LLMD District 1, there are five zones. Each zone is levied a different amount that is <br />determined by the benefit units each property type (residential, industrial or commercial) is <br />assigned; a single family residence is used as the basic unit of assessment and is assessed an <br />Equivalent Benefit Unit (EBU) of 1.00. In addition to the EBU, the other determining factor in <br />establishing each zone's corresponding assessment is the acreage of each parcel. The costs <br />associated with maintaining the improvements within each zone are then distributed to those <br />parcels within the zone in proportion to the benefit received by those parcels. Only parcels that <br />directly benefit from the improvements are assessed. <br />DISCUSSION/ANALYSIS: <br />On May 6, 2008 the public hearing date for the fiscal year 2008/2009 LLMD 1 rates was set for <br />June 17, 2008. The Preliminary Engineer's Report for FY 2008/2009 was prepared by Muni <br />Financial and has since been available at the City Clerk's Office. On June 5, 2008 the Colton City <br />News published the time and date of the said public hearing. <br />Assessment rates for all Zones within LLMD 1 were established over twenty years ago, with the <br />exception of Tract 16912 which was annexed into Zone 3 last fiscal year. Tract 16912 was <br />annexed into Zone 3 with an annual three percent inflator. As all the other parcels within District 1 <br />were annexed into the District without an inflator, the rates cannot be adjusted to meet the service <br />costs without a vote by the owners of the parcels within each Zone.
