CONFLICT OF INTEREST: <br />None <br />RECOMMENDATION AND ALTERNATIVES: <br />Staff recommends the City Council/Authority proceed as follows: <br />1. Request staff report presentation from staff; <br />2. Open the public hearing and take public comments; <br />3. Close public hearing; <br />4. Request that City Clerk talley the number of protests received; <br />5. Request that the City Clerk announce the talley. If protest ballots represent less than <br />6,619, the City Clerk shall announce there has been no majority protest and the meeting <br />will proceed. If there are 6,619 protests or more, the protests will need to be verified in <br />accordance with Government Code, Section 53750 and the item should be continued to <br />the next meeting. <br />6. If protests are less than 6,619, City Council should discuss and take action. <br />Staff further recommends the Colton Utility Authority Board review, ratify and to the extent <br />necessary direct that the City Council take one of the following alternative actions: <br />Alternatives: <br />A. Introduce Ordinance. The City Council/CUA Board are asked to waive first reading, read <br />by title only and introduce the attached Ordinance proposing a revised water rate structure and <br />resulting water rate and meter service charge adjustments, as the recommended changes will <br />assist the City and CUA with the need to meet operational, capital, and debt coverage <br />requirements. The ordinance must be approved with 5 affirmative votes. <br />B Denial of the Ordinance. The City Council/CUA Board may deny the ordinance if it is not <br />supported by at least 5 affirmative votes. Should this happen, the water system will not be able <br />to support infrastructure/operational needs and meet bond coverage requirements. Finally, <br />without the increase, the City/CUA will not be able to fund maintenance and repair projects and <br />perchlorate clean-up activities, resulting in higher costs in the future (and larger potential <br />increases).
