Council, Colton shall hold a public hearing before its City Council to review the Draft <br />EIR. At this hearing, the Colton City Council shall review the Draft EIR and take public <br />comment. Colton shall then make comments or recommendations to Riverside. <br />Riverside will work cooperatively with Colton to address and resolve any such comments <br />and recommendations prior to the preparation of the Final EIR. <br />1.2 The proposed project currently includes spreading basins and <br />facilities for the diversion of water from the Santa Ana River to those basins. Colton has <br />requested that the proposed project also include recreational features and be configured to <br />accommodate local circulation requirements for South Colton and will provide to <br />Riverside additional information regarding such features as it becomes available. <br />Riverside agrees to consider and study the addition of these components into the <br />proposed project. <br />1.3 Riverside agrees to fund the cost of Recharge Project <br />environmental analysis, including any recreational elements associated with the <br />improvements. <br />1.4 Riverside and Colton agree to jointly seek grant funding, from <br />federal and/or state funds, for the Recharge Project on terms that are mutually acceptable. <br />2. Pellissier Ranch Specific Plan <br />2.1 Colton is currently in the process of adopting the Pellissier Ranch <br />Specific Plan, which encompasses 1,448 acres of largely undeveloped property in Colton. <br />Riverside currently owns approximately 227 acres within the Specific Plan area. The <br />Specific Plan calls for a combination of open space, commercial, retail, residential and <br />school uses. Colton will continue to fund all costs associated with developing and <br />adopting such Specific Plan, including environmental review. <br />2.2 Riverside agrees to provide an interim sewer connection to accept <br />wastewater delivered by Colton to the RWQCP for treatment and disposal in an amount <br />not to exceed 1,000,000 gallons per day, with a peak flow discharge not to exceed 2.3 <br />cubic feet per second, from the property within the southwest portion of the City of <br />Colton. The parties agree to further negotiate on the terms of such acceptance, with the <br />understanding that the fee that Riverside shall charge for such acceptance will include a <br />50% surcharge in addition to Riverside's normal charge for such acceptance of <br />wastewater. Colton will not be charged capacity fees for this interim sewer connection. <br />A draft agreement is attached as Exhibit A. The final agreement will be substantially the <br />same as this draft agreement and Colton will comply with all of its terms and conditions. <br />2.3 Riverside, through its Department of Public Utilities, has reserved <br />a 37 acre parcel within the specific plan area for utility purposes, either water, electric or <br />both. Colton and Riverside will work cooperatively to identify an alternative location to <br />address the electric utility requirements to minimize any negative impacts from the utility <br />uses on adjacent private development. Colton and Riverside will work cooperatively to <br />quantify the water utility requirements for land within the Specific Plan area and Colton <br />will work to ensure that the Specific Plan accommodates those needs to the greatest <br />extent possible. <br />
