AB 3030 Groundwater Management Plan for Riverside Basin <br />3.1 On December 9, 2008, Riverside's City Council adopted a <br />Resolution of Intent to adopt a groundwater management program ("GWMP") for the <br />Riverside North and South Basins. A portion of the Riverside North Basin is located in <br />Colton. The proposed GWMP provides the framework for coordinating groundwater <br />management activities among stakeholders. The plan will identify the basin management <br />goals and objectives needed to guide efforts to effectively manage the groundwater basin <br />as a safe and sustainable water supply. The proposed GWMP will not alter any <br />provisions of the stipulated judgment entered in the case entitled Western Municipal <br />Water District of Riverside County et al. v. East San Bernardino County Water District, <br />Case No. 117628, and will require approval by the court-appointed Watermaster and <br />concurrence by the other stakeholders in the basin. <br />3.2 Colton agrees to participate in the preparation and environmental <br />analysis of the GWMP, and to consider adoption of the GWMP for those portions of the <br />Riverside North and South Basins that lie within Colton. Colton will also act as a <br />responsible agency for the GWMP pursuant to CEQA. <br />3.3 Riverside further agrees to seek appropriate environmental review <br />for the GWMP, and consider Colton's comments to the same. <br />4. John W. North Sewer Discharge Permit <br />4.1 The parties agree that upon resolution of the Wells 30 and 31 <br />Dispute, as memorialized in a settlement agreement approved by both City Councils, <br />Colton shall, within five working days, issue such permit to Riverside for the treatment of <br />JW North sewer discharge. A draft permit is attached as Exhibit B. The final permit <br />issued to Riverside will be substantially the same as this draft permit and Riverside will <br />comply with all of its terms and conditions. The terms of this MOU shall not relieve <br />Riverside from the responsibility to pay any and all fees and/or charges in accordance <br />with the fee schedules, ordinances and resolutions adopted and amended from time to <br />time by Colton, including but not limited to those related to permitting, capacity, <br />inspection and treatment. <br />5. RIX Facility <br />5.1 RIX is owned and administered by a Joint Powers Authority, <br />consisting of City of San Bernardino and Colton. Prior to beginning any environmental <br />analysis for any change or alteration to RIX that would increase the actual treatment <br />capacity for RIX, Colton agrees to informally discuss any such change or alteration with <br />Riverside. <br />5.2 Colton further agrees to seek appropriate environmental review for <br />any such change or expansion, with the concurrence of other members of the JPA, and <br />consider Riverside's comments to the same. <br />5.3 Colton agrees that by execution of this MOU, Riverside does not <br />waive any legal rights to challenge the environmental analysis. <br />M <br />
