(ii) Explaining the methodology used to calculate traffic growth in the vicinity of the Project and the incorporation of Project traffic into the traffic growth projections. (iii) Clarifying the baseline concerning the traffic signal synchronization and related level of service description. (iv) Clarifying the sufficiency of the traffic mitigation measures in light of the Addendum's additional analysis of traffic related impacts. WHEREAS, the Addendum has been presented to the City and having reviewed and considered the information contained therein, the City has determined that the Addendum addresses the issues identified in the writ of mandate issued by the Court; and WHEREAS, the City finds that none of the circumstances specified in Public Resources Code section 21166 subparts (a) through (c) or California Code of Regulations, Title 14 ("the State CEQA Guidelines"), section 15162 have occurred and that the preparation of a subsequent or supplemental EIR or negative declaration in conjunction with the approval of the Project is not required by CEQA; and WHEREAS, the Addendum, attached hereto as Exhibit "A" and made a part hereof, to the certified Final EIR was prepared pursuant to CEQA and the State CEQA Guidelines; and WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, THE CITY COUNCIL FOR THE CITY OF COLTON DOES RESOLVE AS FOLLOWS: SECTION 1. Recitals. The above recitals are incorporated herein by reference. SECTION 2. Compliance with the California Environmental Quality Act. As the decision- making body for the Project, the City has reviewed and considered the Final EIR for the Project, the Addendum, any oral or written comments received, and the administrative record prior to making any decision. The City fords that the Addendum addresses all of the issues raised by the court in its writ of mandate and contains a complete and accurate reporting of the environmental impacts. The City further fords that the Addendum has been completed in compliance with CEQA and the State CEQA Guidelines. SECTION 3. Findings on the Necessity for a Subsequent or Supplemental Environmental Impact Report. Based on the Addendum and all related information presented to the City, the City finds that the preparation of a subsequent or supplemental EIR is not required for the Project because the addendum is merely a minor modification and such a minor modification: (1) does not constitute a substantial change to the Project that will require major revisions of the Agua Mansa Commerce Center Final EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; (2) does not constitute a substantial change with respect to the circumstances under which the Project is undertaken that will require major revisions of the Agua Mansa Commerce Center Final EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of the previously identified significant effects; and (3) does not contain new information of substantial importance that was not known and could not have been known with the exercise of reasonable diligence at the time the Agua Mansa Commerce Center Final
