(ii) Explaining the methodology used to calculate traffic growth in the vicinity of the Project and the <br />incorporation of Project traffic into the traffic growth projections. <br />(iii) Clarifying the baseline concerning the traffic signal synchronization and related level of service <br />description. <br />(iv) Clarifying the sufficiency of the traffic mitigation measures in light of the Addendum's additional <br />analysis of traffic related impacts. <br />WHEREAS, the Addendum has been presented to the City and having reviewed and considered <br />the information contained therein, the City has determined that the Addendum addresses the issues <br />identified in the writ of mandate issued by the Court; and <br />WHEREAS, the City finds that none of the circumstances specified in Public Resources Code <br />section 21166 subparts (a) through (c) or California Code of Regulations, Title 14 ("the State CEQA <br />Guidelines"), section 15162 have occurred and that the preparation of a subsequent or supplemental EIR <br />or negative declaration in conjunction with the approval of the Project is not required by CEQA; and <br />WHEREAS, the Addendum, attached hereto as Exhibit "A" and made a part hereof, to the <br />certified Final EIR was prepared pursuant to CEQA and the State CEQA Guidelines; and <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. <br />NOW, THEREFORE, THE CITY COUNCIL FOR THE CITY OF COLTON DOES <br />RESOLVE AS FOLLOWS: <br />SECTION 1. Recitals. The above recitals are incorporated herein by reference. <br />SECTION 2. Compliance with the California Environmental Quality Act. As the decision- <br />making body for the Project, the City has reviewed and considered the Final EIR for the Project, the <br />Addendum, any oral or written comments received, and the administrative record prior to making any <br />decision. The City fords that the Addendum addresses all of the issues raised by the court in its writ of <br />mandate and contains a complete and accurate reporting of the environmental impacts. The City further <br />fords that the Addendum has been completed in compliance with CEQA and the State CEQA <br />Guidelines. <br />SECTION 3. Findings on the Necessity for a Subsequent or Supplemental Environmental <br />Impact Report. Based on the Addendum and all related information presented to the City, the City finds <br />that the preparation of a subsequent or supplemental EIR is not required for the Project because the <br />addendum is merely a minor modification and such a minor modification: (1) does not constitute a <br />substantial change to the Project that will require major revisions of the Agua Mansa Commerce Center <br />Final EIR due to the involvement of new significant environmental effects or a substantial increase in <br />the severity of previously identified significant effects; (2) does not constitute a substantial change with <br />respect to the circumstances under which the Project is undertaken that will require major revisions of <br />the Agua Mansa Commerce Center Final EIR due to the involvement of new significant environmental <br />effects or a substantial increase in the severity of the previously identified significant effects; and (3) <br />does not contain new information of substantial importance that was not known and could not have been <br />known with the exercise of reasonable diligence at the time the Agua Mansa Commerce Center Final <br />
