EIR was certified, that shows any of the following: (a) the Project will have one or more significant <br />effects not discussed in the Agua Mansa Commerce Center Final EIR; (b) significant effects previously <br />examined will be substantially more severe than shown in the Agua Mansa Commerce Center Final EIR; <br />(c) mitigation measures or alternatives previously found not to be feasible would in fact be feasible and <br />would substantially reduce one or more significant effects of the Project, but the lead agency declined to <br />adopt such measures; or (d) mitigation measures or alternatives considerably different from those <br />analyzed in the Agua Mansa Commerce Center Final EIR would substantially reduce one or more <br />significant effects on the environment, but which the lead agency declined to adopt. <br />SECTION 4. Findings on Environmental Impacts. Based on the Addendum, the administrative <br />record, and having considered all written and oral evidence presented to the City, the City finds that all <br />environmental impacts requiring additional analysis pursuant to the September 1, 2009, Peremptory Writ <br />of Mandate and Judgment ("Court Order") have been addressed within the Addendum for the Agua <br />Mansa Commerce Center Project. The City finds that no new or additional mitigation measures or <br />alternatives are required for the Project. The City further fords that the Addendum contains a complete, <br />objective, and accurate reporting of the environmental issues for which the Court required additional <br />analysis and reflects the independent judgment and analysis of the City. <br />SECTION 5. Adoption of the Addendum. The City hereby approves and adopts the Addendum <br />therein that was prepared to provide the additional analysis required by the Court Order. <br />SECTION 6. Notice of Determination. The City directs City staff to file a Notice of <br />Determination with the San Bernardino County Clerk within five (5) days of approval of the Addendum. <br />SECTION 8. Execution of Resolution. The Mayor of the City shall sign this resolution and the <br />City Clerk of the City of Colton shall attest and certify to the passage and adoption thereof. <br />THIS RESOLUTION SHALL TAKE EFFECT UPON THE DATE OF ITS ADOPTION. <br />APPROVED AND ADOPTED THIS 15t' DAY OF DECEMBER, 2009. <br />KELLY J.
