Staff Report to the Mayor and City Council <br />G&G Environmental Pretreatment Services <br />November 16, 2010 <br />Page 2 <br />ISSUES/ANALYSIS <br />G&G Environmental Compliance, Inc. (G&G) has been retained since January 2004 to provide the <br />essential program services including inspection, monitoring, reporting, and compliance related <br />activities for the Pretreatment Program. <br />The City's Wastewater Reclamation Facility (WRF) has added treatment capacity since the <br />previously issued permit and the discharge limits, contained in the new NPDES Permit No. CA <br />0105236, have changed to reflect new water quality standards established by the State of California. <br />As a result of the aforementioned changes, the permit requires the City to re-evaluate the existing <br />local discharge limits for commercial and industrial discharges to ensure adequacy and that the <br />limits reflect current conditions. G&G has completed the initial review for "pollutants of concern" <br />which is the first step in this re-evaluation process. <br />The existing contract has approximately $4,300 remaining, which will cover the pretreatment <br />expenses through October 31, 2010. The City of Colton's WRF remains in compliance with <br />effluent limitations in their current permit; however, the existing local limits were adopted prior to <br />employing the treatment provided by the Rapid Infiltration/Extraction (RIX) Facility, which <br />provides tertiary treatment. The new local limits must consider the treatment provided by both <br />facilities to be technically based and legally defensible. G&G personnel are very familiar with the <br />City of Colton's wastewater treatment capabilities; the permitted industrial user contributions; and, <br />have the experience needed to prepare technically based and legally defensible local limits. <br />Based on G&G's current familiarization with the status of the program, qualifications and ability to <br />meet the CUA's operational and technical needs, and their ongoing work related to local limits <br />development, it is recommended that G&G Environmental Compliance, Inc. be awarded a contract <br />for FYI 0/11 including the option for the City Manager to extend the Agreement for up to three (3) <br />additional one-year periods under the same terms. In previous fiscal years, the Wastewater Division <br />solicited Requests for Proposals from six (6) pretreatment program management firms. Two firms <br />submitted proposals, while the remainder did not respond or indicated that they were unable to <br />perform the work in the necessary time frame and did not submit a proposal. The two firms that <br />responded were G&G Environmental and Krieger & Stewart. Krieger & Stewart is no longer <br />performing pretreatment program services. <br />Colton Municipal Code Section 3.08.140 (E) authorizes the City Council to waive competitive <br />bidding for professional services when it concurs with the City Manager's determination that such <br />an action is in the best interest of the City and its administrative operations. The City Manager <br />believes this is the case in this situation because G&G Environmental has made major <br />improvements in the Pretreatment Program including favorable feedback from the Board and EPA, <br />increased revenue from new permits being issued, a reduction in sewage spills and backups into <br />homes. In addition, as discussed above, in the most recent requests for proposals for similar <br />services, G&G has either risen to the top or was the only firm to respond. <br />
