Staff Report to the Mayor and City Council <br />Laurel Grade Separation Project <br />November 16, 2010 <br />Page 2 <br />entered into a funding agreement for the proceeding design and environmental phases of this <br />project. Attached as Exhibit A, is the proposed Cooperative Agreement for Engineering Design <br />and Environmental Compliance Phase of Laurel Street Grade Separation Project. This <br />agreement is a funding agreement between the City of Colton and SANBAG. The estimated <br />costs for the engineering design and environmental compliance for the Project is $4,100,000. <br />The agreement restates that the City of Colton will be the lead under the California <br />Environmental Quality Act (CEQA) and will be the responsible party for final project approval <br />under CEQA. The funding for these phases of the project will be shared as follows: SANBAG <br />88.08% and City of Colton 11.92%. BNSF and UP are not contributing to this <br />Engineering/Environmental Phase, which thereby requires the CITY and SANBAG to contribute <br />more to this phase than they would otherwise be obligated to do. Both UP's and BNSF's full <br />percentage obligation of the Total Project Costs for the entire Laurel Street Grade Separation <br />Project will be accounted for in either the Right -of -Way Phase or the Construction Phase, and the <br />obligations of the CITY and SANBAG during those phases will be reduced accordingly. <br />Also attached, as Exhibit B, for consideration is the Trade Corridor Improvement Fund Project <br />Baseline Agreement. Funds being used by SANBAG to provide for their percentage <br />contribution for this Project include Trade Corridor Improvement Funds and as such approval of <br />a Baseline Agreement for the Project is required. The Baseline Agreement identifies the Project <br />schedule, scope and benefits, and a draft Project Study Report. <br />FISCAL IMPACTS <br />The City of Colton's contribution of the engineering and environmental costs is estimated at <br />$488,720; this is 11.92% of the $4,100,000 estimate for this work. These funds have been set <br />aside and appropriated through the FY 2011 budget adoption. <br />ALTERNATIVES <br />1.
