(hereinafter referred to as <br />"Property Owner"). <br />RECITALS <br />WHEREAS, certain real property (APN# 027416106), described in Exhibit "A", <br />(hereinafter referred to as "Property") is located outside the City's boundaries; and <br />WHEREAS, Property Owner wants sewer service to be provided to Property; and <br />WHEREAS, the City and Property Owner believe that the City can provide <br />efficient sewer service to Property; and <br />WHEREAS, City's sewer service to Property is subject to the Property Owner <br />obtaining approval of the Local Agency Formation Commission pursuant to California <br />Government Code Section 56133; and <br />WHEREAS, Property will remain outside the City's boundaries; and <br />WHEREAS, annexation of Property to the City is not required so long as sewer <br />service under this Agreement is strictly limited to Property; and <br />WHEREAS, Property Owner will not oppose any future annexation proceeding <br />concerning the annexation of Property to the City; and <br />WHEREAS, the City has agreed to provide sewer service subject to certain <br />terms and conditions set forth in a separate agreement; and <br />
