TO: HONORABLE MAYOR and CITY COUNCIL <br />FOR: Council Meeting of 7 May 1991 <br />FROM: Jaime R. Aguilera, Director of Community Development <br />SUBJECT: Urgency Moratorium on Petition for Mobile Home Rent <br />Increase or Decrease <br />BACKGROUND: <br />The City Council approved the original Rent Stabilization Ordinance (0-19A-89) in 1989. <br />The Council considered an Urgency Ordinance to amend that Ordinance at your meeting <br />of April 16, 1991. At that time, the Council was advised by legal staff that the ordinance <br />should not be adopted as an urgency matter due to technical reasons. At tonight's <br />meeting, the Council considered said amendments to Ordinance O -19A-89 through a <br />regular Ordinance process. <br />STATEMENT OF THE PROBLEM: <br />The regular Ordinance adoption process will take an additional 45 days to complete. It is <br />contended that during that time, a "party" may exercise its priveledge of filing for a rent <br />adjustment under the existing Ordinance. <br />ANALYSIS: <br />If the Council assumes that there is a real threat that a petition for a rent increase may be <br />filed within the 45 day Ordinance approval process, and if the Council wishes to preclude <br />that from occuring, the Council should consider adopting an Urgency Moratorium as <br />explained in the attached Ordinance prepared by Best, Best & Krieger.
