c PERMISSION TOENTER PERMISSION IS HEREBY GRANTED to SAN BERNARDINO VALLEY MUNICIPAL WATER DISTRICT to enter in, over and upon a section of a parcel.of land, known as Municipal Park. Said parcel of land has been determined to be owned by the City of Colton and is more particularly described as the south west corner of Municipal Park (Colton Avenue and "E" Street). It is understood that this permission isnot an easement and is not a waiver in any way of the right of ownership for, or interest in, such land. The PERMITTEE hereby agrees to,, and shall, hold the CITY OF COLTON, its elective and appointive boards, commissions, officers, agents, and employees harmless from any liability`for damage for personal injury„ including death, as well as from claims for property damage which may arise from the PERMITTEE or from any the PERMITTEE'S contractor's, subcontractors agents', or employees' operations under this "PERMISSION TO ENTER", whether such operations be by the PERMITTEE or by any of. the PERMITTEE'S contractors, subcontractors, or by any one or more persons directly or indirectly employed by, or acting as, agent for the PERMITTEE or any of the PERMITTEE'S contractors, subcontractors, agents or employees. PERMITTEE agrees to, and shall, defend CITY and its elective and appointive boards, commissions, officers, agents, and employees from any suits or actions at law or in equity for damages caused, or alleged to have been caused, by reason of any of the aforesaid operations; provided that the aforesaid hold harmless agreement by the PERMITTEE shall apply.to all damages and claims of damages of every kind suffered, or alleged to have been suffered, by reason of any of' the aforesaid operations referred to in this paragraph, regardless of whether or not the PERMITTEE has prepared or supplied, and the CITY has approved of, plans and/or specifications for the project and operations for which this "PERMISSION TO ENTER" is obtained. PERMITTEE further agrees that this "PERMISSION TO ENTER" shall be binding upon his/their executors, administrators, heirs, assigns, and invitees. This "PERMISSION TO ENTER" is granted in consideration of the location and construction of such monitoring well and incidental appurtenances, which it is understood are requested by the SAN BERNARDINO VALLEY MUNICIPAL WATER DISTRICT, and shall continue in effect until such improvement construction and well monitoring is completed or until said PERMITTEE has completed the purchase of said property from the CITY OF COLTON.
