PERMISSION TO ENTER <br />PERMISSION IS HEREBY GRANTED to SAN BERNARDINO <br />MUNICIPAL WATER DISTRICT to enter in, VALLEY <br />over and upon a section of a <br />parcel of land, known as municipal Park. Said parcel of land has <br />been determined to be owned by the City of Colton and is more <br />particularly described as the south west corner of Municipal <br />(Colt" 6! <br />on Avenue and EPark <br />�ZStreetj. It is understood that this <br />permission is not an easement and is not a waiver in any way of the <br />right of ownership for, or interest in, such land. <br />The PERMITTEE hereby agrees to and shall, hold the CITY OF <br />COLTON, its elective and appointive boards, commissions, officers, <br />agents, and employees harmless from any liability for dama <br />personal injury, includingge for <br />death, as well as from claims for <br />Property damage which may arise from the PERMITTEE or from any the <br />PERmITTEE'S contractor's, subcontractors', agents', or empl®yeas°, <br />operations under this "PERMISSION TO ENTER", whether such <br />operations be by the PERMITTEE or by any of the PERMITTEE'S <br />contractors, subcontractors, or by any one or more persons directly <br />I or indirectly employed by, or acting as, agent for the PERMITTEE or <br />any of the FERMITTEE`S contractors, subcontractors, agents or <br />employees. <br />PERMITTEE agrees to, and shall, and <br />defend CITY and its elective <br />appointive boards, commissions' and agents, and employees <br />from any suits or actions at law or in equity for damages caused, <br />or alleged to have been caused, <br />by reason of any of the aforesaid <br />operations; provided that the aforesaid hold harmless agreement by <br />the PERMITTEE shall apply to all damages and claims of damages of <br />every kind suffered, or alleged to have been suffered, by reason of <br />any of the aforesaid operations referred to in this paragraph, <br />regardless of whether or not the PERMITTEE has <br />prepared or <br />supplied, and the CITY has approved of <br />for the .plans and/or specifications <br />project and operations for which this "PERMISSION TO ENTER <br />is obtained.
