R-03-93 <br />A RESOLUTION OF THE CITY OF COLTON <br />CITY COUNCIL APPROVING THE APPLICANT'S <br />APPEAL OF THE PLANNING COMMISSIONFS <br />DECISION CONCERNING AN AMENDMENT OF <br />TRAFFIC FEES FOR FILE INDEX NUMBER <br />DC -61-92. <br />WHEREAS, the Planning Commission of the City of Colton did <br />hold a public hearing for File Index Number DC -61-92 on November <br />24, 1992 to consider the applicant's request for an amendment to <br />the Conditions of Approval concerning Traffic Impact Fees; and <br />WHEREAS, the Planning Commission did approve the reduction of <br />impact fees to $11,320.00; <br />WHEREAS, the applicant feels that the fee of $11,320.00 is <br />unjustified and has requested a further reduction of the fee to <br />either $6,632.00, based on the Institution of Traffic Engineer's <br />criteria, or $6,115.00 based on Caltrans' criteria; <br />WHEREAS, the City Council finds that the appeal is justified, <br />based on the information presented; <br />NOW THEREFORE, BE IT RESOLVED by the City Council of the City <br />Of Colton that the finding and decision of the Planning Commission <br />were incorrect and be it further resolved that the City Council <br />hereby overturns said finding and decision for File Index Number <br />DC -61-92 and thereby approves the applicant's appeal to a fee <br />found to be justifiable by the same. <br />PASSED, APPROVED, AND ADOPTED this 5th day of January, 1993. <br />ATTEST: <br />HELEN A.
