2 <br />RESOLUTION NO. <br />3 <br />4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />SUPPORTING LEGISLATION TO ELIMINATE UNFUNDED FEDERAL MANDATES <br />6 <br />7 WHEREAS, The City of Colton is facing accelerated costs due to unfunded federal <br />8 mandates; and <br />g WHEREAS, Congressman Gary A Condit, as a committee member of the Committee <br />on Government Operations, which has jurisdiction over federal mandates, is supporting <br />10 legislation to eliminate unfunded federal mandates; and <br />11 WHEREAS, unfunded federal mandates on State and Local governments have become <br />12 increasingly extensive in recent years; and <br />13 WHEREAS, such mandates have, in many instances, added to growing deficits in <br />State and Local budgets and have, resulted in the., need for Local governments, such as the <br />14 City of Colton, to increase revenue or curtail services; and <br />15 WHEREAS, federal mandates such as Safe Drinking Water Act, NPDES Wastewater <br />16 Discharge, Industrial Waste Pretreatment,Federal Sludge Disposal Regulations, NPDES <br />Stormwater Regulations and many more continue to mount mandated costs on underfunded <br />117 local governments such as the City of Colton; and <br />18 WHEREAS, Congressman Gary A. Condit (D-CA) will introduce legislation to assure <br />19 that the federal government pays the total amount of direct costs incurred by State and Local <br />governments in complying with certain requirements which take effect on or after the date <br />20 of enactment of the Act under a Federal statute or regulation; and <br />21 WHEREAS, this legislation will be introduced, at the beginning of the 103rd <br />22 Congress; and <br />I <br />23 WHEREAS, this legislation would provide that any requirement under a Federal <br />statute or regulation that a State or local government conduct an. activity (including a <br />24 requirement that a government meet national standards in providing a service) shall apply <br />25 to the government only if all funds necessary to pay the direct costs incurred by the <br />government in conducting the activity are provided by the Federal Government ; and <br />26 <br />WHEREAS, the City of Colton has experienced an increase from $1.8 to $2.0 million <br />27 I in operating costs annually, and a requirement for $26.0 million in construction costs <br />28 i pending as federal mandated costs with more still to come; and <br />i <br />i <br />
