LAW OFFICES OF , <br />BEST, BEBT'& KRIEGER <br />June 8, 1993 <br />MEMORANDUM <br />TO: MAYOR, CITY COUNCIL, CITY MANAGER <br />FROM CITY ATTORNEY <br />RE: RESOLUTION OF THE CITY OF COLTON DESIGNATING THE CITY <br />CLERK TO TAKE MINUTES DURING CLOSED SESSIONS <br />Attached for your consideration is a proposed Resolution which would <br />authorize the City Clerk pursuant to the provisions of the Ralph M. Brown Act to attend <br />all closed sessions of the City Council for the purpose of taking minutes of such session. <br />Government Code Section 54957.2 authorizes the City Council to designate a clerk or other <br />officer or employee of the City who shall then attendeach closed session of the City Council <br />and keep and enter in the minute book a record of topics discussed and decisions made at <br />the meeting.. The minute book made pursuant to this section is not a public record subject <br />to inspection pursuant to the California Public Records Act .and shall be kept confidential. <br />The minute book is only available to members of the City Council or, if a violation of the <br />Brown Act is alleged to have occurred at a closed session, to a court. Such minute book <br />may, but need not, consist of a recording of the closed session. The attached Resolution <br />simply provides for the City Clerk to keep a written minute book. <br />If you wish to adopt the attached Resolution, a simple motion authorizing its <br />adoption would be appropriate. The Resolution' will become effective immediately. A copy <br />of Government Code Section 54957.2 is attached for your review. <br />
