The change in dental insurance coverage at <br />i.ssue was Made in the fall of 199i0 At rhat rime� all plan panicipants, <br />iaicluding IBEW members a»d representatives, w+ere notified and <br />imformational meetings were held. IBEW and its members failed to ask m <br />�eet a�d canfer or file a grievance over this issue u�uil over a year later. <br />2. 77ee change in derual insurance was dictared to the Cify by the carrier. In <br />�ther words, the City had no choice but to discorainue the plan previously <br />i� e,,�'ect. <br />3. 1HIOU's entered into by 1BEW since the change in the der�al insurance <br />Flan in the fall of 199�0 have incorporated the new plan by reference under <br />�nicle IIl, Section 3, which sraxes.• "The City shall prouide derual <br />insurance for each represented employee and eligible dependenrs � <br />¢ccordance with existing Citv 'dental ,pla►rs. '(Emphasis added.) This <br />Ianguage also suggests that the panies intended to go with whatever <br />dental plan was availabte from the carrier. Had they intended otherwise, <br />they would have insened language similar to that ,found in Article lll, <br />�ection I, regarding medical insurance coverage, which stares in peninent <br />part: "Should such Health Net coverage cease ro be availahle during che <br />term of this MOU, the parties shall meet and confer on an equivalent <br />calternative health plan.
