La Cadena Drive Colton�, C,� 92324 Re: Arbitration of Colton Dentai Grievance (Case No. 92-3-157} Dear �orcfon: {n acc�orda�nce with the provisions o# MOU Article VI, Section 7, C.6., please be advised that IE3EW tocal 47 hereby appeals the decision of Arbitrator Lou Zigman in case 92-3- _ 157 (C:oltan dental grievance) to fhe Ci#y Councii. ' The Unioru's appeal is based' on the arbitrator's specific determination that the grievance was tiine-barred. Undisputed testimony at the hearing was that the Union did not become aware of the change until February 1992 and, from that'point on, discussions to attempt ta find a rQsotution began. The grievance was not filed until the City served notice on the Union thafi they woutd not remedy the situation. The issue of timeliness was never raised by th+� Cifi,� during discussions nor during #he grievance procedure. Pleas� advise me or Hank Colt as soon as possible as to the date the appeal witF be consideresi by the City Council.
