1 ,n*e* <br />Preservation Officer shall be exercised by the Historical Preservation f � <br />2 Commission. <br />3 (6) The Commission shall hold a public hearing on all applications for <br />4 Certificates of Appropriateness referred to it after notice is given in the same <br />5 manner as Section 15.40.080 (b) (4). <br />6 (7) Using the Colton Design Guidelines, the survey, the designation <br />7 report, and the Preservation Officer' s report, the Commission shall review <br />8 any major alterations, appeals of staff determinations, and subdivisions, lot <br />splits, and new construction within historic and scenic districts and make a <br />g determination with due speed to approve, approve conditionally, or deny the <br />10 Certificate of Appropriateness. Approval requires finding that the action <br />11 proposed is consistent with this Ordinance and will not be detrimental to a <br />12 historic resource, or that the action is necessary to correct an unsafe or <br />13 dangerous condition pursuant to Section 15.40.120 (a). In case of <br />14 <br />hardship, the applicant may apply for a Certificate of Hardship pursuant to (' <br />F � <br />Section 15.40.090 (d). <br />15 (8) A report of the action taken or determination made shall be <br />16 forwarded to the City Council, and a copy of the decision sent to the <br />17 applicant by mail and, if appropriate, to the City departments responsible for <br />18 issuing necessary permits. The Commission ' s decision shall be in writing i <br />19 and shall state the findings of fact and reasons relied upon in reaching its <br />20 decision. <br />21 (9) After Commission approval, the Building Official shall issue the <br />permit applied for provided that all requirements of City and State Codes, <br />22 including the Historical Building Code, are met. If the Commission fails to <br />23 consider an application for a Certificate of Appropriateness within sixty (60) <br />24 days of the date of submission of the application, the Community <br />25 Development Department shall issue the building permit. Any person not <br />26 satisfied with a determination by the Historic Preservation Commission may <br />27 appeal to the City Council. Such appeal shall be made in writing and <br />28 delivered to the office of the Community Development Director. No permit <br />16 <br />I <br />
