AGENDA REPORT
. CITYOF COLTON
For City CouncU Meeting of )/
March ,E 997I 1 l 117
March 13, 1997
TO: MAYOR GAYTAN, CITY COUNCIL CITY MANAGER
FROM: Julie Hayward Biggs, City Atto e
SUBJECT: Possible Revision of Commissioner Appointment Ordinance
As you are aware, it was previously proposed that the Commissioner Appointment
ordinance be revised in accord with the provisions of Government Code Section 40605. That
code provision requires that the Mayor appoint, subject to approval by the City Council, all
members of all City boards and commissions. The statute also states that the only limitation
on this requirement is where other state law controls the appointment of such boards or
commissions. Our current provisions in this regard exempt only the Library Board from the
Commissioner Appointment ordinance. Legal review by the law firm of Rutan & Tucker
indicates, however, that the City may also exempt the Planning Commission from the provisions
of Government Code Section 40605.
Attached is a revised copy of the previously proposed amendment to our
Commissioner Appointment ordinance (Chapter 2.30 of the Colton Municipal Code) that
complies with the provisions of Government Code Section 40605 as interpreted by the law firm
of Rutan & Tucker.
If the Council wishes to amend the current City Code, it would be appropriate to
place this or another amended ordinance on the next City Council agenda for first reading.
Concurren
t t
Malik Dantala Freeman, City Manager
Item No. 30
