COMPROMISE SETTLEMENT AGREEMENT RELEASE <br />AND COVENANT NOT TO SUE <br />This Agreement is made by and among plaintiffs City of Colton, on the one <br />hand, and defendant Colton Police Officers Association, on the other hand, and is a <br />compromise settlement and release whereby the parties hereto mutually extinguish their <br />respective rights and claims arising from disputes and differences as to the rights, duties, and <br />obligations each has or may have against the others. <br />RECITALS <br />WHEREAS, certain disputes and differences have arisen between the parties to <br />this Agreement. <br />WHEREAS, said disputes and differences have resulted in certain litigation <br />entitled Citv of Colton v. Colton Police Officers Association, San Bernardino County <br />Superior Court, Case Number 39979 (hereinafter referred to as the "ACTION"); and <br />WHEREAS, the parties now desire to resolve all claims asserted against one <br />another in the ACTION. <br />NOW, THEREFORE, in consideration of the above premises and of the <br />following covenants, it is hereby agreed as follows: <br />COVENANTS <br />1. The Colton Police Officers Association and its members, officers, <br />agents, employees, representatives, and all persons acting in concert or participating with <br />them, shall not engage or perform, directly or indirectly, any and all of the following acts: <br />striking or calling or inducing a strike or work stoppage, including a work slowdown, or <br />C OLTON 10.016/COLTON 16.100/07-28-97/DMB/FMH <br />
