7. The release provisions of paragraphs 5 and 6 above shall not extend to <br />and shall not include: <br />(a) Any claim arising from subsequent events, or any claims involving <br />the City of Colton and the Colton Police Officers Association which are not related directly <br />to the ACTION; <br />(b) Any claims with respect to present or future claims asserted by <br />third parties. Members, officers, agents, employees, representatives, and all persons acting <br />in connection or participating with the Colton Police Officers Association shall not be <br />considered third parties; or <br />(c) Any claims of the Colton Police Officers Association, its members, <br />officers, agents, employees, representatives, and all persons acting in connection or <br />participating with the Colton Police Officers Association relating to events outside the scope <br />of employment. <br />8. It shall be an express condition precedent to this Agreement that it shall <br />be approved and ratified by the City of Colton City Council at a properly convened meeting <br />thereof. The City of Colton may waive this condition in writing. <br />9. The parties agree that this Agreement is a good faith settlement of <br />litigation as provided under California law and agree to cooperate fully with any parry <br />making any motion for such determination, and to join in the motion, if it is determined by <br />either party that such a motion is necessary. <br />10. The parties each agree that this Agreement is a compromise of the <br />above-described claims and shall never be treated as an admission of liability by any party <br />COLTON10.016/COLTON16.100/07-28-97/DMB/FMH 5 <br />
