hereto for any purpose, and that liability is therefore expressly denied by each of the parties <br />hereto. <br />11. The parties represent and warrant that they are presently the sole and <br />exclusive owner of their respective claims, demands, causes of action, controversies, <br />obligations, or liabilities as set forth in the ACTION, and that no other party has any right, <br />title, or interest whatsoever in said causes of action and other matters referred to therein. <br />12. This Agreement shall not constitute any precedent which binds the City <br />of Colton with respect to any specific course of action or disciplinary action regarding any <br />future alleged wrongdoing, misconduct, or infractions by the Colton Police Officers <br />Association, its members, officers, agents, employees, represneatives, and all persons acting <br />in connection with or participating with the Colton Police Officers Association. <br />13. The Colton Police Officers Association represents and warrants that it <br />is authorized to bind its members, officers, agents, employees, representatives, and all <br />persons acting in connection with or participating with the Colton Police Officers Association <br />to the terms of this Agreement and shall indemnify and hold harmless (including attorneys <br />fees and costs) the City of Colton should any Colton Police Officers Association member, <br />officer, agent, employee, representative, and anyone acting in connection or participating <br />with the Colton Police Officer Association proceed against the City of Colton, in whatever <br />forum, based upon the acts and claims contained in the ACTION. <br />14.
