2.2.4: In the event the AMIGA Plan proceeds, and in accordance with 2 i 3 law and the criteria required for issuance of Section 10(a) Permits, to consider all 4 funding proposals, including appropriate, fair share contributions from 5 1 participating cities and counties to the City to assist in the obligations undertaken pursuant to Section 2. 1, hereof 7 2.2.5: Actively participate in and provided immediate and consistent 8 9 guidance for any HCP effort undertaken by the City pursuant to Section 2. 1, 10 hereof, and in the event a city-wide HCP is approved, as part of such approval, to 11 consider all funding proposals, including the reimbursement from that plan to the 12 City of funds expended by the City, in advance of approval of such HCP, in such 1,3 fair share proportions as may be agreed upon between the Service and the City, 14 1 .5 1 consistent with criteria required for issuance of Section I 0(a) Permits. 16 2.3: MISCELLANEOUS MATTERS: 17 2.3.1: In the event the Service, Visy and the City agree upon the location 18 19 and amount of the Conserved Land and the location of the Visy Project, the service agrees that, pursuant to the provisions of Section 10(a) of the Act 20 and the 21 1 issuance of a Section 10(s) Permit, the City of Colton and Visy will have 22 authorization to take DSF to the limit described in the HCP, Section 10(a) Permit 23 and the Implementing Agreement ("IA") - 24 2.3.2: The Service agrees, consistent with the provisions of law, that it 25 shall process a 10(a) Permit application for the CAMC Lands within three (3) 26 27 months of the publication of the Notice of Availability in the Federal Register, 28 provided that such application meets the permit issuance criteria set forth in the MOU - Fish & Wildlife service and the City of Colton, California Page 6 T
