In addition, it will be necessary to reach 15 agreement regarding the extension and location of roads, railway lines and other 16 1 infrastructure. 17 2.2.2: To the extent permitted by law, and within thirty (30) days from 18 such date upon which the Service, Visy and City reach agreement pursuant to 19 20 paragraph 2.2.1, and upon such terms as may be agreed upon by Visy, the City 21 1 and the Service, give Visy a conceptual concurrence letter noting that the HCP 22 and NEPA documents must receive appropriate analysis and public review, and 23 that take of DSF may not occur until a Section 10(a) permit is obtained. 24 2.2.3: Use its best efforts to secure state and federal financial assistance 25 26 in an amount of not less than $ 1,000,000 to assist the City and other jurisdictions 27 which may participate in a regional multiple species habitat conservation planning 28 effort which includes the DSF.
