I D. The city manager may elect to have any meeting at which charges or <br />2 complaints may be discussed about him or her and/or the hearing referenced inara ra h <br />3 P g P <br />4 (A) of this section 2.16.070 to be either public or in closed session of the city council <br />5 in accord with applicable provisions of the Ralph M. Brown Act (California Government <br />6, Code Sections 54950 et sep.). <br />7 E. If the city manager's removal results from a publicly disclosed charge <br />8 impugning the city manager's honesty, morality or community standing and the city <br />9 manager contests the charge, the hearing referenced in paragraph (A) of this section <br />10 <br />11 2.16.070 shall be mandatory and may be held before or after the effective date of <br />12 termination as required by California law." <br />13 <br />14 SECTION 2: If any provisions of this Ordinance or application thereof to any person <br />15 or circumstances is held invalid, this invalidity shall not affect other applications of this <br />16 Ordinance which can be given effect without the invalid provision or applications, and t <br />PP o this <br />17 <br />18 end, the provisions of this Ordinance are declared to be severable. This Ordinance shall be <br />19 liberally construed to achieve the purposes of this Ordinance and to preserve its validity. <br />20 <br />21 <br />22 PASSED, APPROVED AND ADOPTED by the people of Colton, California at a <br />23 special election to be consolidated with the county -wide election to be held on Tuesday the <br />24 <br />25 th day of 1997. <br />26 <br />27 <br />28 <br />6 <br />
