EMERGENCY WATER SALES AGREEMENT AMONG <br />THE CITY OF COLTON , <br />THE SAN BERNARDINO VALLEY MUNICIPAL WATER DISTRICT <br />AND <br />RECHE CANYON MUTUAL WATER COMPANY <br />Upon execution of this Water Sales Agreement ("Agreement") between The City of Colton <br />CCity") the San Bernardino Valley Municipal Water District ("Muni") and Reche Canyon Mutual <br />Water Company ("Mutual") the parties agree, covet, and, proclaim: <br />WHEREAS, Mutual is a non-profit mutual water agency organized to provide domestic water <br />service to approximately fifty customers located in Riverside County, adjacent to the City of <br />Colton; and, <br />WHEREAS, Muni is a special district organized as a municipal corporation under applicable <br />provisions of California law having statutory jurisdiction with regard to delivery of water to <br />property located in both San Bernardino and Riverside Counties; and, <br />WHEREAS, City is a municipal corporation located in the County of San Bernardino and <br />organized under the general laws of the State of California; and, <br />WHEREAS, the City owns and operates a municipal water company providing the domestic <br />water needs to residences and businesses located within the City limits; and, <br />WHEREAS, the City has water distribution facilities located in San Bernardino County that are in <br />close proximity tOiNutual; and, <br />WHEREAS, Mutual has expressed a need to purchase emergency water from the City;. and, <br />WHEREAS, both City and Mutual are members of Muni who retains jurisdiction of inter -county <br />water transactions between member agencies; and, <br />WHEREAS, THE City, Mutual, and Muniall agree that it is in the best interest for safety, <br />reliability, and public welfare to consummate this agreement. <br />NOW THEREFORE, the City, Mutual, and Muni agree to the terms as follows: <br />1. TERM <br />A. This Agreement shall remain in effect until terminated as provided in Section 5 of this <br />Agreement. <br />2. SERVICES TO BE RENDERED <br />A. The City will deliver emergency domestic water to Muni via the City's domestic <br />distribution system to the metering point where the City is interconnected with Mutual. <br />B. Muni will cause the water to be delivered to Mutual under the established obligations of <br />Muni. <br />3. FEES AND RATES <br />A. Upon execution of this Agreement, Mutual shall pay the sum of sixty-five hundred <br />dollars ($6,500) to City to pay for the costs of the four inch (4") interconnection, 4" <br />
