meter, and meter pit which will then be available to deliver water to the Mutual water <br />system. <br />B. Starting with the first deliveries of water to the Mutual system, Mutual shall pay the <br />sum of six hundred eighty-three dollars and sixty-two cents ($683.62) per month to <br />City for the first twelve month of service as the Customer Charge. No water will be <br />included with this amount. Beginning with the thirteenth month of service, and <br />thereafter, the customer charge payable to City will be $25.29 monthly. <br />C. All water delivered through the interconnection by City will be billed at a rate of fifty- <br />five cents ($0.55) per hundred cubic feet. The meter will be read and billed monthly <br />by City. <br />D. Rates for emergency water ;delivered to Mutual by City shall be subject to periodic <br />change if the cost to serve the emergency water change. The City will provide Mutual <br />with at least sixty days notice of any such change and provide adequate <br />documentation to justify the rate change. <br />E. No fees, charges or payments shall accrue to Muni from Mutual as a result of this <br />Agreement. In addition, Muni shall not, in the execution of their obligation to deliver <br />the emergency water sold under this Agreement, impose any additional charge, fee, or <br />other payment or financial obligation on Mutual or City as a result of this Agreement. <br />4. PAYMENT AND INQUIRIES <br />A. The interconnection account will be billed monthly by City and pay will be made in <br />accordance with the City's adopted Rules and Regulations for water service. Any <br />Inquiries regarding the bill shall be made to the City of Colton, Finance Department. <br />B. Any questions regarding the physical interconnection, water quality, or problems with <br />water delivery shall be made to the City of Colton, Utility Department, Water Division. <br />5. TERMINATION <br />A. This Agreement shall be terminated upon ninety (90) days written notice by any party <br />B. Upon termination, all obligations to Mutual from the City and Muni, shall cease and the <br />physical disconnection of the water service shall be performed. <br />C. Reestablishment of emergency water service can restored upon payment of <br />appropriate fees and contractual closure with Muni. <br />i� <br />6. NON -DEDICATION` OF FACILITIES <br />A. Any provision of this Agreement shall not constitute the dedication of the system or <br />any portion thereof either Party to the public, a third party, or to the other Party, and it <br />is understood and agreed that any such undertaking by any Party shall cease upon the <br />termination of this Agreement. <br />7. NO THIRD PARTY RIGHTS <br />A. This Agreement shall not be construed to create rights in, or to grant remedies to, any <br />third party as a beneficiary of this Agreement, or of any duty, obligation or undertaking <br />established herein. <br />i <br />I <br />i <br />
