VEGA, FINANCE DIRECTOR <br />SUBJECT: RESOLUTIONS FOR THE 1997- 98 FISCAL YEAR ASSESSMENT LEVY <br />OF THE LANDSCAPE AND LIGHTING MAINTEANCE DISTRICT NO. 1 <br />(LLMD NO. 1) <br />DATE: APRIL 22, 1997 <br />BACKGROUND <br />The City Council previously formed a Landscape and Lighting Maintenance Assessment <br />district. This formation was accomplished pursuant to the provisions of the Landscaping <br />and Lighting Act of 1972, Part 2 of Division 15 of the Streets and Highways Code of <br />California. This Act provides for the levy and collection of assessments by the County of <br />San ,Bernardino for the City of Colton to pay the maintenance and services of lighting, <br />landscaping, and all appurtenant facilities and operations related to the LLMD No. 1. <br />The LLMD consists of 8 Zones of which five (5) Zones have an annual levy. The benefit <br />Zones are Cooley Ranch (Zone '1), La Loma Hills (Zone 3), Old Colton (Zone 4), Reche <br />Canyon (Zone 5) and West Valley (Zone 8). The improvements within the District include: <br />turf, ground cover, street trees, irrigation systems, perimeter landscaping, slopes, open <br />space, lighting systems and all necessary appurtenances. The costs associated with the <br />improvements are equitably spread between all benefiting parcels within the Zones. Only <br />parcels that receive direct benefit from the improvements are assessed. <br />DISCUSSIONIANALYSIS <br />Prior to a Public Hearing the Act requires that certain resolutions be adopted. The required <br />resolutions are Initiating Proceedings for the Annual Levy of Assessments, Declaring <br />Intention to Levy the Annual Assessment and Preliminary Approval of the ,Annual Levy <br />Report. <br />The Preliminary Report has been prepared by MuniFinancial; Inc. for the various LLMD <br />Zones and is attached. The LLMD expenses have not increased and there are no additions <br />to the District, therefore the report reflects the same budget and assessment as 1996-97. <br />There are no recommended increases for 1997-98. <br />Section 7 of the resolution Declaring Intention to Levy Annual Assessments gives notices <br />that a Public Hearing regarding the LLMD will be held on Tuesday, June 17,1997. At this <br />time the City Council will hear testimony regarding the Preliminary Report of revenue and <br />expenditures contemplated for 1997-98. <br />Item No. 8 <br />
