Planning Commission- March 25, 1997 <br />Page 2 <br />Mr. Soto said that staff found that the building is under a uniform sign program. In <br />March 1989 a request for six signs was denied, and two signs were approved. The <br />decision was appealed and in April, 1989, the City Council approved the uniform sign <br />program for 900 East Washington Street, which allows only three building signs and <br />one monument sign. At this time, there are already four existing signs, including one <br />approved by staff in 1996. Staff was unaware of the three sign restriction at the time of <br />approval of the fourth sign, for Friendly Hills Medical Group. At this time, the applicant <br />now requests approval of the logo to the existing sign. Mr. Soto said that it is staffs <br />recommendation that no further signs be allowed on the building, and based on staffs <br />analysis, it is recommended that the Planning Commission deny File Index Number DV - <br />60 -96. Mr. Soto said the applicant is not present, due to a knee injury. <br />Public Hearing Opened. <br />Public Hearing Closed. <br />Commissioner Hayden made a motion to approve staff's recommendation of denial for <br />File Index Number DV -60-96; seconded by Commissioner Oliva, motion carried <br />unanimously, <br />3. FILE INDEX NUMBER DC -47-96 TOM L. THEATRES <br />(FANTASY THEATRE) <br />Director Zamora _ summarized the staff report, stating. that the request is for a <br />Conditional Use Permit and Environmental Assessment to allow for liquor sales for on- <br />site consumption, at 1091 South La Cadena. Director Zamora said the business <br />currently operates as a legal, non -conforming business, and beer and wine are sold. <br />The applicants have stated that they are requesting the Conditional Use Permit in order <br />to remain competitive in the area. <br />The business is located in an Industrial Park (IP) Zone and an adult business is not <br />allowed in an IP designation; it is currently operating as a legal, non -conforming use. It <br />is staff's opinion that granting a Conditional Use Permit for liquor sales will increase the <br />discrepancy between existing conditions and the standards prescribed by the General <br />Plan; therefore, the request is inconsistent with the guidelines of the General Plan. <br />Director Zamora stated it is staff's opinion that granting a Conditional Use Permit for <br />liquor sales will increase the discrepancy between existing conditions and the <br />standards prescribed by the Zoning Ordinance; therefore, staff has determined that the <br />proposed project is inconsistent with the intent and guidelines of the Zoning Ordinance. <br />An Initial Study was processed; no responses were received from responsible <br />agencies. The Design Review Committee considered the proposal on November 18, <br />1996 and voted unanimously to recommend denial of the request for a Conditional Use <br />Permit for liquor sales. <br />--- <br />
