AGENDA REPORT
CITY OF COLTON
For City Council Meeting of
May 6, 1997
May 1, 1997
TO: MAYOR GAYTAN, CITY COUNCIL AND CITY MANAGER
FROM: Julie Hayward Biggs, City Atto e
SUBJECT: Urgency Ordinance/Clerical Correction
The Community Development Department has brought to my attention the need
for a clerical correction to Ordinance No. 0-02-97, the ordinance establishing the City's new
adult business regulations. In the course of preparing that ordinance, our outside legal counsel
included a section repealing Chapter 18.48 in its entirety. The intent of the ordinance was not
to repeal all of that chapter, but rather simply to repeal Section 18.48.010 of the chapter, dealing
with adult businesses. As the remaining provisions of Chapter 18.48 have continuing value to
the City and are necessary for appropriate code enforcement, it is imperative that those
provisions which were inadvertently repealed, be reinstated.
Accordingly, outside legal counsel has prepared the attached ordinance (at no cost
to the City) correcting the clerical error that was included in Ordinance No. 0-02-97. This
correction is being presented as an urgency measure and requires a two-thirds vote -(5 affirmative
votes) for passage.
Concurrence⢠
y----------------------
'eQ h
Malik Dantala Freeman, City Manager
ITEM# 19
