AG R_jEM ENT <br />THIS AGREEMENT, made and entered into in triplicate this day of <br />by and between the CITY OF COLTON, CALIFO&NIA, a <br />Municipal Corporation, hereinafter called City, and <br />--.W. vS%'LC_Vk ztjog' C,,4. <br />hereinafter called Developer: <br />WITN_ESsETH <br />WHEREAS, <br />pursuant to Ordinance 1520, Developer is Planning construction <br />of a development in said City of Colton, California, <br />to be known as <br />being a development of <br />and desires approval of said development prior to the completion of the improve- <br />ment work upon condition that Developer enter into this written agreement with <br />City, wherein developer agrees to complete said improvement work in accordance <br />with the provisions hereinafter set forth and to furnish faithful performance <br />and laborer and materialmen's surety bonds, or furnish other approved documentary <br />assurances guaranteeing to City completion of said improvement work and payment <br />of claims of laborers and materialmen furnishing labor and/or materials in the <br />construction of said improvements to the limits set forth in said bonds; <br />NOW, THEREFORE, IT IS MUTUALLY AGREED between the parties hereto as follows: <br />I.. Developer Promises and agrees to <br />furnish all equipment, material, <br />labor and engineering services necessary for the construction and completion of <br />all work required by City to be done in said development as sb(r-:n upon the plans <br />and profiles or schedule thereof on file In the office of the Community Services <br />Department of said City, and approved by the City Engineer of city, which said <br />plans and profiles, or schedule, are incorporated herein by reference as though <br />set forth fully herein. <br />2. The improvement work required by City, as sltlm-a upon Saie plans and <br />Profiles, Or schedule, shall include all impro=rements required by F1,1- <br />
