OPERATIONS AND MAINTENANCE CONTRACT <br />FOR <br />COLTON 1 SAN BERNARDINO REGIONAL TERTIARY TREATMENT AND <br />WATER RECLAMATION PLANT <br />THIS .CONTRACT is made and entered into, this day of 19 6 , (the <br />"Effective Date"), by and between the "COLTON/SAN BERNARDINO REGIONAL TERTIARY <br />TREATMENT AND WATER RECLAMATION AUTHORITY", a joint powers agencyof the <br />-State of California, herein after referred to as "AUTHORITY", and the CITY OF SAN <br />BERNARDINO, hereinafter referred to as "CONTRACTOR." <br />WITNESSETH: <br />WHEREAS, "AUTHORITY' is the owner of a Regional Tertiary Treatment and Water <br />Reclamation Plant which is located at 1990 Agua Mansa Road, Colton, California, 92324; ,and <br />WHEREAS, "AUTHORITY" is desirous of retaining an operator to operate and maintain <br />the Tertiary Treatment Plant and Water Reclamation Plant and related facilities; WHEREAS, <br />"CONTRACTOR" warrants that it has the ability and the personnel necessary to operate said <br />Tertiary Treatment and Water Reclamation Plant and related facilities in accordance with all Federal, <br />State and local laws and regulations and in accordance the generally_ accepted practices for such <br />operation; and <br />WHEREAS, "CONTRACTOR" is agreeable to entering into a7 -contract for such purposes:. _ <br />NOW, THEREFORE, the parties hereby agree as follows: <br />1- <br />
