01r'08/1998 17:18 909-430-2828 CJUSD ADMIhl SVCS PAGE a JOINT USE AGREEMENT FOR FACILITY USE Between the City of Colton and The Colton Joint Unified School District This Agreement entered into on the I day of by the City of Colton and the Colton Joint Unified School District, hereafter referred to as "City' and "District." WHEREAS, the Education Code of the State of California authorizes and empowers public school districts and municipalities to cooperate with each other for the purposes of providing meaningful leisure and educational opportunities, and toward that end enter into agreements with each other for the purpose of organizing, promoting and conducting such programs of communityrecreation and education objectives for children and adult citizens of the State; and, WHEIREAS, in order to minimize the duplication in the provision of these services, and to maximize the potential for quality programs, bath agencies are committed to cooperation with one another whenever feasible; and, WHEREAS, the City is the owner of a municipal pool facility at the Cotton Corrmunity Center, located at 670 Colton Avenue, Colton, California; and, WHEREAS, the District wishes to utilize the City swimming pool facility from February 16, 1998 to on or about May 14, 1998, NOW, THEREFORE, the parties agree as follows: L TERM: The term of this Agreement shall be for a period of four months, commencing February 16, 1998, and ending on or about May 14, 1998. Time of daily usage shall be from 2.30 to 5:00 p.m. I:. CONS-1-DERATION: A. During the terns of t#js Agreement, the City of Colton shall make the pool and all accompanying facilities available for use by the District ftom February lb, 1998, to on or about May 14, 1998. Daily usage times shall be from 2:30 to 5:00 p.n_ L. The District agrees to pay the City for 50% of the heating costs of the pool facility during the time of usage by the District. C. By mutual consent of both parties, this Agreement may be extended through 1999 to include additional water sport programs.
