TOBACCO REDUCTION ENFORCEIVIENTAGREEIVIEN <br />THIS AGREEMENT ("AGREEMENT') IS ENTERED INTO BY AND BETWEEN <br />THE COUNTY OF SAN BERNARDINO ("COUNtY") ON THE ONE HAND, AND THE <br />CITY OF COLTON ("CITY") ON THE OTHER HAND, WITH REGARD TO THE <br />FOLLOWING: <br />RECITALS <br />WHEREAS, environmental tobacco smoke is a major cause of indoor air pollution; <br />WHEREAS, breathing environmental tobacco smoke is a cause of disease, <br />including heart disease's and lung cancer, in nonsmokers; <br />WHEREAS, environmental tobacco smoke has been characterized as a Group A <br />carcinogen by the United States Environmental Protection Agency; <br />WHEREAS, the State of California has enacted anti-smoking laws, including Labor <br />Code, section 6404.5, effective: January 1, 1995, to protect employees by eliminating <br />smoking in enclosed work places; <br />WHEREAS, the COUNTY, through its Department of Public Health (the "Health <br />Department'), enforces anti-smoking laws, including the provisions of Labor Code section <br />6404.5; and <br />WHEREAS, the COUNTY's Health Department possesses the necessary <br />personnel, materials, experience, and expertise to enforce anti-smoking laws; and <br />WHEREAS, the CITY wishes to utilize the COUNTYS Health Department for <br />enforcement of 'anti-smoking laws within its jurisdiction; <br />Now, therefore, the parties here to mutually a agree as follows: <br />ffl <br />1 <br />
