Fair Political Practices Commission (FPPC) forwarded a copy of the comprehensive study <br />conducted by the City of Napa in outlining its disclosure categories. If you find Napa's listing <br />easier to follow and to apply, please highlight the number(s) when you complete the Department <br />Report regarding "Designated Employee" by denoting: POSITION TITLE, NAPA 1, 2, 3, etc. <br />The Napa Disclosure Categories used by you will be included in the City of Colton's Disclosure <br />Categories, for future use and reference <br />If you find that the following sections regarding Board/Commissions or Consultants do not apply to <br />your department, you have now concluded with Department Notice and can return it to the City <br />Clerk's Office EgWDIATELY. Thank you for your valuable time and information <br />Section 2. BOARDS OR COMMISSIONS <br />In 1988, the City of Colton commenced listing board/commissions in its Conflict of Interest Code. <br />The practice continued through the years; however, not all of the boards or commissions are <br />included and this office has an arduous task in tracking who should or should not report when <br />assuming or leaving office or when a member has been moved from commission to commission. <br />Another problem arises when an appointee refuses to disclose his/her personal worth. <br />FPPC's guideline on the Facts about Advisory Committees, will assist you in determining the <br />responsibility of the board or commission you facilitate. If you determine that the board or <br />commission is solely advisory, you may direct that the board/or commission NOT be included in <br />the Conflict of Interest Code. This will end annual reporting for those commission members. <br />If you direct that the board or commission falls under the mandate to report, it will be included in <br />the City's Conflict of Interest Code. You need to identify the disclosure category. [See Colton's <br />Appendix "B" and Napa's Appendix B] To use Napa's disclosure listing, highlight the applicable <br />number(s) as follows: POSITION TITLE, NAPA 1, 2, etc. <br />Section 3. Officials Who Manage Public Investments <br />In discussing boards and commissions with FPPC, the Library Board, specifically, stood apart <br />because of its responsibility in managing the library fund, the FPPC representative indicated that <br />depending on the Library Board's duties as to the library fund, the Director -Facilitator could place <br />the Library Board under Government Code Section 87200, requiring full disclosure, or the <br />Director -Facilitator could find that the Library Board qualified for placement under "Designated <br />Employees" and he could affix the applicable disclosure category. In applying Napa's disclosure <br />listing, highlight the applicable number(s) as follows: POSITION TITLE, NAPA 1, 2, etc. <br />Section 4. CONSULTANTS <br />The consultant is defined as an individual, from a business or firm, who pursuant to contract, <br />makes a governmental decision, as described fully in FPPC guidelines, or serves in a staff capacity <br />Conflict of Interest Memo 2 <br />
