and performs all of the same duties for the agency that would otherwise be performed by an <br />individual holding a position specified in the Conflict of Interest Code. <br />Since a consultant position can enjoy a brief stay in the City, the following language will become a <br />part of the Conflict of Interest Code. This will allow the City's authorized representative to declare <br />in writing consultant's standing as a "designated position" and the disclosure category, if necessary. <br />The City Manager or his/her designee may determine in writing <br />that a particular consultant, although a "designated position," is hired to <br />perform a range of duties that are limited in scope and thus is not required <br />to fully comply with the disclosure requirements described in this section. <br />Such written determination shall include a description of the consultant's <br />duties and, based upon that description, a statement of the extent of <br />disclosure requirements. The City Manager or his/her designee's <br />determination is a public record and shall be retained for public record and <br />shall be retained for public inspection in the same manner and location as <br />this Conflict of Interest Code. <br />We trust that the information submitted to you was helpful in the preparation of the Director's <br />Notice.
