PREVAILING WAGES <br />Notice is further given that the legislative body has obtained the general prevailing rate of per <br />diem wages in accordance with law to be paid for the construction of the above-entitled <br />improvement. The schedule has been obtained from the Director of the Department of Industrial <br />Relations, pursuant to the provisions of section 1773 of the Labor Code of the State of California. <br />A copy shall be posted at the job side during the course of construction. <br />PAYMENT <br />Payments will be made in cash to the Contractor in accordance with the provisions of the <br />specifications. The Contractor is advised that he may, at his sole cost and expense, substitute <br />securities equivalent to any moneys withheld by the City to ensure performance under the <br />contract. Such securities shall be deposited with the City or with a state or federally chartered <br />bank as escrow agent who shall pay such moneys to the contractor upon satisfactory completion <br />of the contract. The Contractor shall be the beneficial owner of any securities substituted for <br />moneys withheld and shall receive interest thereon. Securities eligible for investment under this <br />section shall include those listed in Government Code Section 16430 or bank or savings and loan <br />certificates of deposit. <br />BID SECURITY <br />Each proposal shall be accompanied by a certified or cashier's check or bid bond for ten percent <br />(10%) of the maximum total bid. Said check or bid bond shall be made payable to the City of <br />Colton and, when delivered with a proposal, shall constitute a guarantee that the bidder will, if an <br />award is made to him in accordance with the terms of the bidder's proposal, execute a contract in <br />the City's standard form, together with Labor Code Certification thereon; furnish Performance and <br />Payment Bonds with a corporate surety or sureties satisfactory to the City; and furnish Certificates <br />of Insurance evidencing that insurance coverage required by the contract has been secured. <br />AWARD AND EXECUTION <br />The Contractor shall execute the contract within fifteen (15) days after he has been notified in <br />writing of the award, and shall commence work only upon receipt of a"Notice To Proceed" from <br />the City, and shall complete all work and improvements within thirty (30) calendar days after <br />execution. <br />CONTRACTOR'S LICENSE <br />Pursuant to the provisions of Section 3300 of the California Public Contract Code, bidders shall be <br />licensed as required for the various types of work to be performed. No bid will be accepted from a <br />contractor or subcontractor who has not been licensed in accordance with the provisions of <br />Chapter 9, Division III of the Business and Professional Code. At the time the contract is <br />awarded, the Contractor shall possess a Class "A" or a Class "C-57" Contractor's License. <br />1.1-2 <br />
