Parrish, Assistant City Manager <br />SUBJECT: Resolution Directing the City Manager to Effectuate <br />the Termination of the Jack's Disposal Permit as of <br />June 30, 2000. Additionally, amend Section 4.01 b <br />of the Agreement between the City Colton and <br />Taormina Industries <br />DATE: ISeptember 29, 1998 <br />BACKGROUND: <br />On September 25, 1997, Jack's Disposal (Jack's) sent a letter to Interim City Manager <br />Len Wood requesting that its Permit be extended for an additional seven years. <br />Additionally, on August 7, 1998, Jack's faxed a letter and draft resolution to Mayor <br />Gaytan reiterating its previous request that its Permit be extended for an additional <br />seven years. On August 18, 1998, staff presented a report to the City Council <br />recommending that the City Council direct the City Manager and the City Attorney to <br />take the necessary steps to terminate Jack's Permit no later than June 30, 2000. The <br />basis for staff's recommendation was that it was the intention (throughout the <br />procurement process completed in 1996) of the City to award a single solid waste <br />contract for all of the City's service area. <br />After hearing staff's recommendation on August 18, 1998, the City Council directed <br />staff to come back with a resolution extending Jack's Permit with an addendum <br />providing AB 939 Reporting and Indemnification. Staff presented that report to the City <br />Council on September 15, 1998. After hearing comments from the Public the City <br />Council voted not to extend Jack's Permit for an additional seven years. The City <br />Attorney then clarified after the vote, that by acting not to extend Jack's Permit, the City <br />Council essentially reiterated the termination notice that was sent to Jack's by the City <br />Attorney on June 19, 1996. <br />DISCUSSION: <br />In order to prevent future requests from Jack's Disposal to renew its permit, and to <br />bring closure to the issue regarding the intention of the City of Colton when it went <br />through the procurement process, staff is bringing before the City Council an <br />amendment to the Taormina Contract. The attached amendment will effectively <br />transfer Jack's accounts to Taormina upon termination of its Permit. <br />FISCAL IMPACT: <br />There would be no direct fiscal impact as a result of this action. <br />Item # 21 <br />
