Parrish, Assistant City Manage <br />SUBJECT: Consider Extension of Jack's Disposal Permit, for the Collection, <br />Removal, Recycling and Disposal of Solid Waste within the City of <br />Colton with an Addendum Regarding AB 939 Reporting and <br />Indemnification. <br />DATE: September 7, 1998 <br />BACKGROUND: <br />On August 18, 1998, a motion was approved by the City Council requesting staff to <br />bring forward (on September 1, 1998), an extension of Jack's Disposat - Service <br />("Jack's") Permit for the Collection, Removal, Recycling and Disposal of Solid Waste <br />within the City of Colton ("the Permit"). Additionally, the motion requested an <br />addendum be added to the existing Permit requiring Jack's to provide the City with <br />quarterly and annual reports with respect to recycling activity and diversion (in the City <br />of Colton). Also, the motion requested that Jack's provide indemnification to the City <br />against all fines and penalties imposed by the State of California (if the City, with <br />respect to solid waste collected by the Permitee, does not meet diversion goals). <br />While the motion was explicit in that staff bring this item back before the Council on <br />September 1, 1998, when considering the drafting and reviewing parties involved, and <br />the dates established by the City Clerk and the City Manager for preparation and <br />review of reports, it was not possible to meet that deadline. For this item to have been <br />considered on September 1, 1998, it would have to been delivered to the City <br />Manager's Office by Monday, August 24, 1998. As can be seen from the matrix below <br />the first draft of the proposed Resolution was not received by our office until Tuesday <br />afternoon, August 25, 1998.
