SEP -10-98 THIJ 09:55 AM WARD NORTH AMERICA FAX NO. 7145441979 P,02 <br />CLAIM SERVICI' A RE -N <br />This Agreement is between Ward North America, hereafter referred to as "Service <br />Company" with its principal offices at 610 West Ash Street, San Diego, California 92101, and the <br />City of Colton, hereafter collectively referred -o as the "Client. " <br />WHEREAS, the Service Company operates a business that pt-ovides claims adniUstration <br />services; and <br />WHEREAS, the Client has requested that the Service Company Perform certain services <br />on its behalf with respect to liability claims on the terrns set forth below, <br />NOW THEREFORE, in consideration of the foregoing muraal promises the parties hereby <br />agree: <br />ARTICLE I <br />TERM OF A GREEI4IENT: <br />This Agreement shall be effective for a period of three years cotz mincing September !, <br />1998 and ending August 31, 2001, and shall remaia in force and effect until ameuded or canceled <br />as provided in the cancellation clause. <br />AR'T'ICLE II <br />SERVICE COINPAN-17 AGREES TO: <br />A. Upon receipt of any claim, make immediate contact w th the City to discuss the <br />allegations contained in the claire, the investigation needed, and contact with the <br />claimant. At this titrte a determination will be made as to the method of contact <br />with the claimant, either by phone or in person. if personal contact is deemed <br />necessary, a determination will be made as to whether contact will be made by City <br />staff or Ward. <br />13. Contact a'_l claimants wirbitr 24 hours of receipt of the clamn. All unrepresented <br />claimants will be provided an 800 number for contact with Ward. <br />C. Work with the City to develop an emergency response plan :fer serious incidents, <br />including sewer back-ups. <br />
