Tenant is in the business of housing and caring for large, non- <br />domestic cats, such as lions, tigers and leopards ("Cats"). Tenant shall use the pranises only for the <br />purpow of establishing a sanctuary for the housing and care of Cats ("Sanctuary"). <br />3.4.2 Standard A,nDrAhle i Aw. Tenant shall operate the Sanctuary with the highest <br />standards of care and concem for the safety of its employees, guests, invitees and the general public. <br />In addition, Tenant shall operate the Sanctuary in strict accordance with all applicable federal, state <br />and local laws, rules and regulations. <br />3.4.3 Linytatj W. Tenant shall have no more then one hundred and filly <br />(ISO) Cats located within the Sanctuary at any one time without the prior written consent of <br />Landlord's Planning Commission. In addition, the Sanctuary may only be opened to the public on <br />the days and during the times approved in advance and in writing by Landlord's City Manager. <br />Finally, any activities provided for the benefit of the rx,blic, incbtding but not limited to, entertainment <br />-activities involving the Cats, shall be subject to the prior written approval of the Landlord's City <br />Manager. It is understood, acknowledged and agreed that the City Manager may refer any decisions <br />within his or her discretion under this Agreement to the Planning Commission for review and <br />approval. It is also understood, acknowledged and agreed that any decision made by the Planning <br />Commission under this Agreement is subject to written appeal by the Tenant to the City Council <br />within ten (10) days of its receipt of notice of the decision by the Planning Commission. <br />3.5 COMPLIANCE- WITH LAWS, RULES, REGULATIONS. Tenant, at its sole cost <br />and expend shall at all times comply with the requirement$ of All applicable local, state and federal <br />laws, rules, orders and regulations now in force or which may hereinafter be in form. In the event <br />of a breach of any provision of this Section 3.5, Landlord shall have the right to terminate this <br />Agreement pursuant to Section 3.17.2. <br />3.6 REPAIRS AND MAUSIMNANCE. Tm vtt shell keep the Premises in good condition. <br />and repair, and in a clean and sanitary manner. Tenant shall surrender the same at termination of this <br />Agreement in as good condition as received, normal wear and tau excepted. Tenant shall be <br />responsible for all other damages caused by itself or that of its officials, officers, employees, invitees <br />or guests. Tenant shall be responsible, at its sole cost and expense, for maintaining and keeping in <br />good condition and repair all strictures, buildings and attachments on the Premises. Tenant shall <br />maintain, at its sole coat and expense, all Tenant -owned facilities required to provide electric, water, <br />and sanitation services to the Premises and Tenant's structures, buildings and attachments. <br />3.7 UTTT-ITMS-. Tenant shall establish and maintain, at its sole cost and expense, utility <br />service(s) for the Premises and Tenant's structures, buildings and attachments in accordance with the <br />City of Colton's Customer Service Policy, as well as all applicable laws, rules and regulations. <br />Landlord shall7ovide non -potable water for domestic use other than human consumption.
