PARTIES AND DATR. <br />'Phis Lease Agreement ("Agreement") is made and entered into this 15th day of September, <br />1998, by and between the City of Colton, a municipal corporation ("Landlord"), and Tiger Rescue", <br />a So l (c)(3) non-profit, mutual benefit corporation with its principal place of business at 1350 do 1370 <br />Agam Manse Rodd, Colton, California 92324 ("Tenant"). Tenant and Landlord may sometimes be <br />referred to herein as the Parties.. <br />2. RECITALS. <br />2.1 Landlord is the owner of certain unimproved real property located at 1350 and 1370 <br />Agua Mansa Road, City of Colton, County of San Bernardino, State of California, more particularly. <br />described in Exhibit "A" attached hereto and incorporated herein by reference ("Prorniga ). <br />2.2 Tenant desires to lease flom Landlord, and Landlord desires to lease to Tenant, the <br />Premises upon the terms and conditions set forth herein. <br />3. Terms. <br />3.1 RIGH' OF POSSESSION. Landlord hereby leases to Tenant, and Tenant hereby <br />leases from Landlord, the Pretni s on the terms and mulitions homer set forth in this <br />Agreement. <br />3.2 TERM. The term of this Agreement shall commence ow September 15, 1999 <br />("Effective Date") and shall end eighty-four (84) months after the Effective ]date ("Initial 'Perm" ), <br />unless terminated earlier as provided herein. 'Tenant may extend the Initial Term of this Agreemma <br />for an additional twenty. -four (24) month term by providing written notice to Landlord of its intent <br />to extend the Initial Term. Said written notice must be received by Landlord at leant ninety (90) days <br />Prior to the end of the Initial Tem. <br />3.3 RENT. Tenant dmN pay to Landlord, as rent for leasing the Prernisok one hundred <br />and fifteen dollars (S 115.00) per month ("Rent" ). Rent shall be due and payable on l st day of each <br />month, Tenant hereby acknowledges that late payment by Tenant to Landlord of Rent will cause <br />Landlord to incur costs not contemplated by this Agreement, the exact amount of which will be <br />extremely difficult to ascertain. Accordingly, if any installment of But shall not be received by <br />Landlord within twony (20) days after such amount shall be due, Tenant shall pay to Landlord a late <br />charge equal to ten percent (106%) of such overdue amount, as weN as interest on the outstanding <br />amount which shall accrue at the rate of ten percent (10%) per annum.
