bNs28250 <br />Rev. 6/17/93 <br />� w <br />s <br />Developer represents and warranties that it has budgeted <br />and reserved sufficient funds to acquire the Site and <br />construct the Developer Improvements thereon in <br />accordance with this Agreement. <br />b. Payment of Traffic Impact Fees <br />Notwithstanding Subsection (a) above, Developer shall pay <br />to the City the first Twenty -Five Thousand Dollars <br />($25,000.00) in Traffic Impact Fees imposed by the City <br />against each of the three parcels comprising the Site. <br />The Agency shall pay or cause the City to waive all <br />Traffic Impact Fees in excess of the first Twenty -Five <br />Thousand Dollars ($25,000.00) assessed against each of <br />the three parcels. <br />5. (5309) Construction Schedule <br />After the conveyance of the Site to Developer, Developer <br />shall promptly begin, and thereafter diligently prosecute <br />to completion, subject to Section 603 of the Agreement, <br />the construction of the Developer Improvements on the <br />Site. Developer shall begin and complete all <br />construction and development within the times specified <br />in the Schedule of Performance (Attachment No. 2). <br />—34— <br />Exhibit "C <br />
