HUTTON, DIRECTOR OF PUBLIC WORKS� <br />l�� <br />SUBJECT: RESOLUTION ORDERING THE LEVY AND COLLECTION OF <br />ASSESSMENTS WITHIN THE LANDSCAPE AND LIGHTING <br />MAINTENANCE DISTRICT NO. 1(LLMD NO. 1) <br />DATE: JULY 12, 1999 <br />BACKGROUND: At the July 6, 1999 City Council meeting, Council adopted its Resolution of <br />intention to hold on August 3, 1999 its annual Public Hearing for the Levy of Assessments <br />pursuant to provisions of the Streets and Highways Code, Landscape and Lighting Act of 1972. <br />The City Council after preliminary review of the engineer's report is required to approve the final <br />report, along with the summary of assessments for the 1999/2000 annual tax levy for the LLMD <br />No. 1. <br />DISCUSSION/�NALYSIS• The District provides maintenance, service and operation of <br />landscapes anrJ lighting improvements and associated appurtenances located within the public <br />right-of-way and dedicated landscape easements, which are throughout the City. As stated <br />above, the District includes five (5) distinct Zones. Each Zone has specific improvements and <br />services that provide special and direct benefit to the parcels within the Zones. The costs. <br />associated with the improvements are equitably spread between all benefiting parcels within the <br />zones. Only parcels that receive direct benefit from the improvements are assessed. <br />Attached is the engineer's report, which describes the general improvements and services within <br />the district and �detailed information for each of the five zones. A map of the district along with a <br />work schedule and a list of staff responsible will be presented during the Public Hearing. <br />FINANCIAL IMPACT: The method of assessment spread is based on equivalent dwelling units <br />(EDU) per parcel. Pursuant to the Act, the costs of the District may be apportioned by any <br />formula or meth�od that fairly distributes the net amount to be assessed. The formula used for <br />each zone reffects the composition of the parcels, and the improvements ar.e service provided to <br />fairly proportion the costs. The proposed assessments for 1999/2000 are unchanged from those <br />levied for fiscal y�ear 1998/99 and accounted for in fund 702. <br />RECOMMEND�TION: Open the Public Hearing and accept testimony.
