Q�� <br />connecting permanent power at the manhole/vault (set for September 15, <br />1996). <br />On demand, City agrees to provide County Architecture & Engineering (A&E) <br />with documentation that, in A&E's judgment, accurately reports on progress <br />In meeting the milestones above and in verifying that provision of electrical <br />power to the Center will occur In conformance with Section 2.11 above, or by <br />any later date that County may require. <br />It is understood that the Electrical Facilities consist of three components: <br />main transmission lines, substation equipment, and distribution <br />lineslequipment to Center. Should City fail to begin actual groundbreaking <br />for all these components at least by December 1, 1995 (or as otherwise <br />agreed between the parties), then within seven (7) days after notice by <br />County, City hereby agrees to provide documentation that, in County's <br />judgment, demonstrates City's ability to meet the Construction Completion <br />schedule as specified in Section 2.12 above. County may then establish <br />additional performance criteria to insure City's timely progress in meeting <br />the Construction Completion schedule, and City agrees to comply with those <br />performance criteria. <br />2.13 Storm Drain: To prevent future disruption of traffic and street - <br />based utilities, County will advance all funds necessary to enable City to <br />complete the Area -Wide Storm Drain Project 3-5, including without limitation <br />E 150 linear feet of storm drain section on Meridian Avenue along the westerly <br />right-of-way at each of the following three locations (all distances are to the <br />north as measured from the centerline of Valley Boulevard): <br />Central Plant Entrance: from a point beginning at 1,215 feet and extending to <br />a point 1,365 feet; <br />Emergency Entrance: from a point beginning at 1,800 feet and extending to a <br />point 1,950 feet; <br />Mental Health Entrance: from a point beginning at 2,555 feet and extending <br />to a point 2,705 feet; <br />In addition, City will place final connection of the above storm drain sections <br />and the southernmost portion of the Santa Ana River outflow as first priority <br />when Phase 11 of the 3-5 Storm Drain construction begins. The sections will <br />become a functional part of the overall storm drain system upon completion <br />of the Area Wide Storm Drainage program per County Ordinance 2-995 <br />adopted March 25, 1991. The County has found and determined that it would <br />be advantageous for the County to advance $1,500,000 towards the <br />construction costs of Phase 11 of the 3-5 Storm Drain, as such costs arise <br />subject to later reimbursement without interest to the County, from <br />development impact fees to be imposed and collected by the City from new <br />development in accord with Section 3.2 of this agreement.
