metal vessels, ashes and all such material that will not incinerate through contact with flames of
<br />ordinary temperature.
<br />"Occupant" includes and means every owner, tenant, occupant or person having the
<br />care or control of any premises within the city.
<br />"Refuse" includes both garbage and rubbish as defined herein; but it does not include
<br />construction materials, broken concrete, dirt from grading, rocks over two-inch diameter.
<br />"Rubbish" includes both combustible and noncombustible waste matter as herein
<br />defined.
<br />"Sanitarian" means the employee charged by the city with the responsibility for the
<br />enforcement of health and sanitary ordinances and regulations. (Ord. 1009 § 1, 1959)
<br />6.16.020 Policy declaration.
<br />The accumulation, collection, removal and disposal of refuse must be controlled by the
<br />city for the protection of the public health, safety and welfare, and to contribute toward
<br />diminution of the presence of air pollutants in the city. The council finds that, to give practical
<br />effect to this policy, a comprehensive system for the periodic collection, removal and disposal of
<br />refuse from all premises in the city is essential and benefits all occupants of premises in the
<br />city, and therefore all such occupants are made liable for the refuse charges authorized under
<br />this chapter. (Ord. 1009 § 2, 1959)
<br />6.16.025 Expansion of refuse collection services.
<br />Effective July 1, 1996, prior to expanding any collection, removal or disposal service
<br />within the city, any person authorized to collect, remove or dispose of refuse within the city shall
<br />request and obtain approval from the city council for modification of the terms of any permit,
<br />franchise agreement or contract in effect in order to allow the requested expansion of its
<br />existing authorized service area. Nothing in this section shall prevent the city from contracting
<br />and/or issuing a franchise or permit for the collection, removal or disposal of refuse within the
<br />city on such terms and conditions as the city council shall determine in order to further the
<br />health, safety and welfare of the residents of the city, provided, however, that the city shall take
<br />no action that impairs or interferes with any existing permit, franchise agreement or contract.

<br />6.16.030 Depositing and burying prohibited --Exception.
<br />No person shall dump, deposit, place or bury in or upon any lot, land or public place, or
<br />in any water or waterway, any refuse, or any deleterious or offensive substance, or any
<br />substance condemned by the sanitarian of the city; provided, however, this section shall not
<br />apply to any land used by the city for a disposal or reclamation site. (Ord. 1009 § 3, 1959)
<br />6.16.040 Refuse accumulation prohibited --Exception.
<br />Every occupant shall keep his premises in a clean and sanitary condition, and shall not
<br />cause or permit any garbage to accumulate on his premises for a period in excess of one
<br />calendar week, or cause or permit any rubbish to accumulate on his premises for a period in
<br />excess of two calendar months; provided, however, that this provision shall not be construed to
<br />interfere with any occupant keeping building materials upon premises during the construction,
<br />reconstruction or repair of a building or structure thereon under a current valid building permit,
<br />nor with the keeping of wood neatly stacked upon such premises for household use. (Ord. 1009

<br />6.16.050 Burning--Garbage--Prohibited.
<br />No garbage shall be burned under any circumstances. (Ord. 1009 § 5(a), 1959)
