CITY OF COLTON <br />AGENDA REPORT <br />Council Meeting of January 19, 1999 <br />TO: Honorable Mayor and Council embers <br />APPROVAL: Henry T. Garcia, City <br />FROM: Daryl J. Parrish, Assistant City Manager <br />SUBJECT: Approve Assignment of Jack's Disposal Services, Inc. Accounts, in <br />the City of Colton to Taormina Industries, LLC, a Subsidiary of <br />Republic Services, Inc. <br />DATE: January 13, 1999 <br />BACKGROUND: <br />On October 6, 1998, the City Council chose not to extend the term of Jack's Disposal <br />Services ("Jack's") Permit beyond June 30, 1999. Additionally, at that time the City <br />Council amended the Agreement between the City of Colton and Taormina Industries <br />to include all accounts previously serviced by Jack's upon the effective date of <br />termination of Jack's Permit. <br />DISCUSSION/ANALYSIS: <br />Recently, letters were received from both Jack's Disposal Service ("Jack's") and <br />Republic Services, Inc. stating that Taormina is in the process of acquiring Jack's <br />accounts in the City of Colton. The Jack's Disposal Permit (section XIII) requires that <br />the Permitee ()ack's) obtain the written consent of the City prior to assigning its <br />accounts to another solid waste hauler. <br />As a result of the transaction between Jacks and Taormina, Jack's will relinquish all of <br />the rights and responsibilities it was granted under the "Permit, Business License and <br />Franchise Agreement for the Collection, Removal, Recycling and Disposal of Solid <br />Waste" entered into by Jack's and the City of Colton on July 1, 1992. Additionally, <br />Taormina will service the customer accounts in the City of Colton previously serviced by <br />Jack's under the terms and conditions established in the 1996 Agreement between <br />Taormina Industries and the City of Colton. <br />FISCAL IMPACT: <br />There is no fiscal impact as a result of this action. <br />RECOMMENDATION: <br />Staff recommends that the City Council authorize staff to effectuate the assignment of <br />accounts in the City of Colton serviced by Jack's Disposal Service to Taormina <br />Industries. <br />Attachments <br />Item # 9 <br />
